Liability For Chicago Transit Authority Bus Accidents
Bus accidents involving the Chicago Transit Authority are unfortunately very common. According to ABC 7, “For CTA buses, [there is a crash every 36 hours]. Every day and a half in Chicago, a city bus is involved in a crash and the I-Team discovered a surprising number of injuries in CTA accident reports.” There are a number of reasons that CTA buses can be particularly dangerous.
- Buses have large blind spots that may obscure the presence of smaller vehicles.
- Buses have a high center of gravity, which makes them more susceptible to rollover collisions.
- Buses have a much wider turning radius than other vehicles.
Buses are considered common carriers, and their drivers are held to a high standard in terms of safety. Many collisions are due to bus drivers that make unsafe lane changes. Pursuant to (625 ILCS 5/11-701), “a vehicle shall be driven in the right-hand lane available for traffic, or as close as practicable to the right-hand curb or edge of the roadway, except when overtaking and passing another vehicle proceeding in the same direction.” Victims of bus collisions tend to suffer very serious and costly injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
- Organ damage
Depending on the facts of any case, liability for a bus accident could extend beyond any driver. A municipal agency like the Chicago Transit Authority could be liable for a collision. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. It is crucial that all evidence related to a fatal bus collision is properly preserved.
