Liability For DuPage County Semi-Truck Accidents
Thousands of pedestrians are killed or seriously injured every year in car accidents. According to the IIHS, “Deaths from motor vehicle crashes with pedestrians have increased 83% since reaching their low point in 2009 and account for 18% of crash fatalities. The rates of pedestrian crash deaths per 100,000 people are highest for people ages 20 and over.” Cities should take a number of measures in order to protect pedestrians from collisions.
- Cities should ensure that intersections are well illuminated.
- Cities should heavily enforce traffic violations likely to lead to pedestrian collisions.
- Cities should consider installing traffic calming measures in areas with a history of speeding.
All drivers have the legal obligation to take reasonable steps in order to avoid collisions. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. They must also use their horns when necessary and exercise the proper precautions to avoid colliding with any child or obviously confused person. If a driver fails to slow down in order to avoid colliding with a person crossing the street, this could form the basis of a negligence claim. It is important that key pieces of evidence be preserved after any collision.
- Eyewitness statements should be collected.
- Surveillance footage should be sought.
- Medical records related to the crash should be reviewed.
- The police report should be examined.
Depending on the facts of any case, liability for a pedestrian accident could extend beyond any driver. If the driver of a truck was working at the time of a collision, their employer could be held at fault. Generally speaking, companies are liable for the wrongful acts of their workers – insofar as they were operating within the course and scope of their job duties. The family of any pedestrian who died in a collision may be able to seek some level of accountability through a civil claim.
