Liability For Chicago Truck Accidents
Car accidents remain one of the leading causes of preventable injury and death in the United States. According to the IIHS, “There were 42,514 deaths from motor vehicle crashes in the United States in 2022. This corresponds to 12.8 deaths per 100,000 people and 1.33 deaths per 100 million miles traveled. The fatality rate per 100,000 people ranged from 4.8 in the District of Columbia and Rhode Island to 23.9 in Mississippi.” Drivers should take a number of actions in order to prevent accidents.
- Drivers should check their blind spots before making turns.
- Drivers should slow down during periods of inclement weather.
- Drivers should be well rested before heading out onto the road.
All drivers have a legal obligation to exercise due care in order to avoid collisions. Many collisions are due to drivers making dangerous left turns. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-902), any person intending to turn left must first yield the right of way to any vehicle traveling from the opposite direction that is close enough so as to pose a hazard.
Depending on the facts of any case, liability could extend beyond any driver. A business could be liable for a collision if their driver was involved in a crash. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. Several steps should be taken after any car accident.
- Eyewitnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- A thorough investigation should be conducted.
Many car accidents are preventable and involve some amount of human error. Victims of these collisions often suffer very serious injuries and may need to take extensive periods of time away from work. It is always a good idea to speak with an experienced attorney after any accident. Any attorney can examine the unique facts of your case and let you know what your legal options are.
