Liability For Fires Caused By Battery Packs

Fires caused by devices with lithium-ion batteries remain alarmingly common. According to WHN9, “Since 1995 more than 1,900 people have been injured and over 300 killed after a battery in a micro-mobility device like an e-bike or e-scooter caught fire. And more than 2,000 were injured and close to 200 died from faulty lithium-ion batteries in products like laptops, according to UL Solutions.” There are a number of defects with lithium-ion batteries that could lead them to catch fire.

  • Lithium-ion batteries could be contaminated with certain materials that create shortcircuits.
  • Lithium-ion batteries may lack critical safety features that shuts off the device in the event of overheating.
  • Lithium-ion batteries may have improper Battery Management Systems.

Companies that create battery packs and other devices with lithium-ion batteries have a legal obligation to ensure that these devices are reasonably safe. They must adhere to all safety regulations set by the Consumer Product Safety Commission. If a battery pack has design defects, this could form the basis of a product liability claim. It is important that certain steps are taken after any battery fire.

  • The device involved in the incident should be preserved.
  • It should be determined if it was on a recall list.
  • Medical records related to injuries should be collected.
  • An experienced product liability attorney should be contacted.

It can be hard to know what to do after any fire caused by a lithium-ion battery. These incidents can often cause significant property damage and even burn down people’s homes. Sadly, the companies that make the devices involved in these incidents will often do everything in their power to deny liability. This is why it is so important for victims to seek legal advice as early as possible.
