Liability For Injuries Involving Vehicle Fires
Accidents involving ATV, OHV and other off-road vehicles remain alarmingly common. According to the Consumer Product Safety Commission, “The dangers of riding off-highway vehicles (OHVs) are real and include overturning, collisions and occupant ejection. CPSC’s latest data show an annual average of more than 800 deaths and an estimated 100,000 emergency department-treated injuries involving OHVs.” Many injuries are also due to fires. Companies that create off-road vehicles should take a number of measures to ensure that they don’t become fire hazards.
- Companies should incorporate the use of fire-resistant materials.
- Companies should ensure that wiring is properly insulated and routed to avoid exposure to heat and sharp edges.
- Companies should ensure that batteries use thermal management systems to avoid overheating.
- Companies should conduct fire safety tests such as heat and flame resistance.
Every company that manufactures consumer goods has a legal obligation to ensure that these products are reasonably safe. This is particularly true for ATVs and other off-road vehicles. These vehicles can be inherently dangerous, especially for children and inexperienced operators. If a ROV company creates a product that has some design defect that could cause a fire, this could form the basis of a strict liability claim. It is important that certain steps are taken after any injury with an ROV.
- Medical records related to the incident should be preserved.
- It should be determined if the affected vehicle was part of a recall.
- An experienced product liability attorney should be contacted.
The vast majority of ATV and ROV fires are completely preventable. They tend to involve situations where companies take certain shortcuts. This could include failing to properly test products. It may also involve using cheaper materials to make batteries or other components. Any person injured in a ROV fire may be able to seek some measure of justice through a civil claim. A product liability attorney can examine all of the unique facts of your case and let you know what your legal options are.
