Liability For Libertyville Truck Accidents

The number of people seriously injured or killed in truck accidents has been going up over recent years. According to the National Safety Council, “Since 2016, the number of trucks involved in injury crashes has increased 18% and the involvement rate per 100 million large truck miles driven has increased 5.7% to 37.” Truck drivers should take a number of measures in order to prevent crashes.

  • Truck drivers should be well rested before heading out onto the road.
  • Trucks should be regularly inspected and well-maintained.
  • Trucks can be equipped with certain safety features, like forward collision avoidance systems.

Truck drivers will typically need to get a commercial driver’s license (CDL) and are held to a high standard in terms of safety. They must exercise a great deal of caution in order to avoid collisions. If a semi-truck driver fails to slow down in order to avoid collisions, this could form the basis of a negligence claim. There could be numerous sources of liability for a truck collision.

  • A truck driver’s employer could be liable if they were working at the time of a collision.
  • The company that marinated a truck could be liable if they failed to maintain a truck in a safe condition.
  • A city could be liable for a collision if it was caused by a dangerous condition on public property.

Truck accidents are often highly preventable. They tend to involve truck drivers that are committing traffic infractions. One of the main causes of truck collisions is driver fatigue. In fact, some studies have estimated that one in ten truck drivers involved in a fatal collision reported feeling under pressure from their carrier. This is why it is so important that evidence is properly preserved after any accident.
