Melii Baby Silicone Spoons for Babies Recalled Because They Can Create Serious Choking Hazard for Infants
CHICAGO, ILLINOIS (January 15, 2025) – Melii Baby Silicone Spoons intended for babies have been recalled because they can cause infants to choke.
The recall was issued on December 19, 2024. Around 85,100 units were sold prior to the recall notice.
According to the Consumer Product Safety Commission, the Melii Baby Silicone Spoons with dinosaurs and unicorns can break apart during use.
This can create a serious choking hazard for babies. Melii Baby received two reports of the spoon breaking.
Liability for Injuries Caused by Spoons
Thousands of children are injured or killed every year due to choking on food and products. According to the New York Department of Health, “Choking is the fourth leading cause of unintentional death in children under the age of 5. Children under age 5 are at greatest risk for choking injury and death.” A choking hazard can be created if any product breaks apart. This could happen for several different reasons.
- The product in question may be made of low-quality materials.
- A product may degrade over time, especially due to exposure to sunlight or heat.
- A product may not have been assembled properly.
- A product may have design flaws, including weak joints or connections.
Companies that create children’s products have a legal obligation to ensure that they are reasonably safe. When a product has design defects that cause harm to a consumer, this could form the basis of a strict liability claim. Liability may fall on the designer of the product as well as the manufacturer. There are several elements that must be demonstrated in any prima facie product liability claim.
- The defendant sold a product the plaintiff used.
- The defendant is the commercial seller of the product.
- The plaintiff sustained an injury.
- When the plaintiff sold the item in question, it was defective.
- The defect was the actual and proximate cause of the injury.
It can be hard to know where to begin if your child has been injured by a defective product. Even when a child survives nearly choking on any product, they may be left with anoxic brain injuries. These types of injuries can dramatically impact their development and overall quality of life. It is important that accident victims take certain steps to protect their rights. They should contact a product liability attorney to preserve evidence and evaluate their case.
