Liability For Injuries Caused By Tub Safety Bars

Falls remain a leading cause of preventable injury in the United States. According to the Centers for Disease Control, “One out of 10 falls results in an injury that causes the older adult to restrict their activities for a day or more or to seek attention from the healthcare system. Each year, there are about 3 million emergency department visits due to older people falls.” Falls can lead to a number of very serious injuries.

  • Fractures
  • Head injuries
  • Sprains
  • Back and spine injuries
  • Hip fractures
  • Traumatic brain injuries

Companies that create products have a legal obligation to ensure that they are reasonably safe. This is particularly important when these products are designed for elderly people who may have mobility issues or medical problems. Older people bear the brunt of serious injuries from falls. When a company sells a product with design defects, this could form the basis of a strict liability claim. It is important that certain steps are taken after any injury caused by a consumer product.

  • It should be determined if the product involved was part of any recall.
  • Medical records related to the incident should be collected.
  • Victims should seek ongoing care and examinations to determine if injuries have become worse.
  • An experienced product liability attorney should be contacted.

Many of the injuries associated with a fall may not be immediately obvious. This is why it is so important for accident victims to seek a medical evaluation as early as possible. They should also consider speaking with a product liability attorney. An attorney can examine all of the unique facts of your case and let you know if you have a valid claim that can be pursued.
