Enerco Issues Recall for DEWALT 70,000 BTU Outdoor Portable Cordless Forced Air Propane Heaters Over Fire Hazard
CHICAGO, ILLINOIS (April 11, 2025) – Enerco recalls DEWALT 70,000 BTU Outdoor Portable Cordless Forced Air Propane Heaters because the device may inadvertently cause fires.
The recall was issued on April 3, 2025. Around 21,250 units were sold prior to the recall.
According to the Consumer Product Safety Commission, the start buttons on the DEWALT 70,000 BTU Outdoor Portable Cordless Forced Air Propane Heaters are not entirely clear. Consumers may press the start button too quickly and prevent the fan from starting.
This can lead the device to potentially overheat and cause a fire. Affected devices were sold exclusively at Lowe’s.
Liability for Injuries Caused By Consumer Products
Faulty consumer products are a leading cause of unintentional fires and burns. According to the Consumer Product Safety Commission, “In 2021 emergency rooms nationwide treated an estimated 193,450 burn injuries involving many types of consumer products, from kitchen and cooking products to fireworks and space heaters.” There are a number of measures that company should take in order to prevent their products from becoming fire hazards.
- Design: Companies should choose component materials that are fire resistant and properly withstand heat.
- Testing: Companies should ensure that they follow all safety standards and perform a fire risk assessment.
- Manufacturing: companies should ensure that they maintain strict oversight of the manufacturing process.
- Warning Labels: Companies must provide clear warning labels about the dangers associated with the use of their product. They must also provide instructions on how the product should be used.
Every company that manufactures and sells products has certain obligations. One of those obligations is ensuring that their product is free of known hazards and reasonably safe. Not all products can be perfectly safe. But products must be free of obvious hazards that would make them dangerous to use when they’re being operated as intended. There are several elements that must be demonstrated in a prima facie case of product liability.
- The defendant sold the product that injured the plaintiff.
- The defendant was also the commercial seller of the product.
- The plaintiff sustained an injury involving the product.
- When the defendant sold the item, it was defective.
- The defect with the item was both the proximate and actual cause of the plaintiff’s injury.
It could be hard to know where to begin if you’ve been injured by a consumer product. In many cases, the severity of a person’s injuries may not be immediately obvious. This can be particularly true with respect to burn injuries. A burn injury may necessitate multiple skin grafts, which can be both expensive and painful. Any person that is injured by a defective consumer product may be able to seek some measure of accountability through a bodily injury claim.
