Delta Cycle Recalls Ceiling Hoists with Straps Due To Injury Risk

CHICAGO, ILLINOIS (September 11, 2024) – Delta Cycle has issued a recall for their Ceiling Hoists with Straps because they can pose an injury hazard to users.

The recall was issued on September 5, 2024. Around 25,000 units were sold, including over 3,000 sold in Canada.

There have been reports that the plastic buckles on the straps can break and pose an injury hazard to consumers. Delta Cycle has received four reports of incidents, including one report of an injury.

The Ceiling Hoists with Straps are used to hold a variety of products, including bicycles, kayaks, ladders, boxes, and other large objects.

Liability For Injuries Caused By Defective Products

Accidents involving consumer products remain alarmingly common. According to the Consumer Product Safety Commission, “In 2020, an estimated 28,535,000 people sought medical attention for an injury related to, but not necessarily caused by, a consumer product. […] The 2020 age-adjusted rate of injury was 8.5 medically treated, consumer product-related injuries per 100 people in the U.S. resident population.” Companies should take a number of measures in order to prevent their products from injuring anyone.

  • Companies should thoroughly test their products in a variety of settings.
  • Companies should follow all safety guidelines for consumer products.
  • Companies should issue prompt recalls when they discover safety defects.

All companies have a legal obligation to create products that are reasonably safe. When a product has inherent defects that may cause harm to a consumer, this could form the basis of a product liability claim. For example, parts of a device may not be strong enough and break during normal use. There are several elements that must be demonstrated in a prima facie product liability case.

  • The defendant sold a product that a plaintiff used.
  • The defendant is the commercial seller of the product.
  • The plaintiff suffered an injury.
  • When the defendant sold the item, the product was defective.
  • The defect was an actual and proximate cause of the plaintiff’s injury.

Injuries involving consumer products can be extremely disruptive to a person’s life. Victims may need to take extensive periods of time away from work. They may also be left with long-term injuries. Any person that is injured by a consumer product may be able to seek some level of justice through a civil claim. A product liability attorney can examine all of the unique facts of your case and let you know what your legal options are.
