Cinmar Issues Recall For Frontgate Resort Collection Newport Aluminum Chaise Due To Finger Crushing and Amputation Risk

Cinmar Recalls Frontgate Chaise Lounge Chairs Due To Finger Amputation Hazard

CHICAGO, ILLINOIS (July 16, 2024) – Cinmar has issued a recall for its Frontgate Chaise Lounge Chairs because they can crush or amputate a person’s fingers.

The hazard occurs when a person is adjusting the backrest while seated. The adjustable backrest may unexpectedly descend with a great deal of force.

This creates a risk that the user’s fingers could be crushed or amputated. About 70,000 Cinmar Frontgate Resort Collection Newport Aluminum Chaises lounge chairs (SKU 67333) have been sold so far.

Cinmar has received three reports of incidents where customers were injured. This includes two partial finger amputations and one injury where a person’s finger was crushed.

Liability For Lounge Chair Injuries

Millions of people are seriously injured by dangerous products every year. According to the National Safety Council, “In 2023, 12.7 million people were treated in emergency departments for injuries resulting from consumer products. Most of the injuries involve everyday products often assumed to be safe. Many of these injuries occur to our most vulnerable populations, older adults and young children.” Companies should take a number of measures in order to prevent their products from injuring consumers.

  • Companies should conduct thorough research and development to ensure products are safe.
  • Companies should implement stringent quality control during the manufacturing process.
  • Companies should ensure that they are compliant with all safety standards set by the Consumer Product Safety Commission and other agencies.

All companies have a legal obligation to create products that are reasonably safe. To that end, they must continuously test their products in all of the ways that they could possibly be used and misused. A company could be held strictly liable if their product has a defect that injures someone. There are three elements that must be demonstrated for a strict liability claim.

  • The product was defective.
  • The defect was present when it left the defendant’s hand.
  • The defect caused the plaintiff’s injury.

When determining whether or not a product is defective, courts have adopted two standards. The first is the consumer expectation standard, and the second is the risk-utility standard. Under the consumer expectation standard, a product is defective if its danger is unknowable and unexpected to an ordinary consumer. Under the risk-utility standard, a product is defective if the risk of harm outweighs the benefits of its design.
