Liability For Products That Cause Skin Irritation

A number of different products can cause skin irritation. According to the National Institutes of Health, “Personal care products like makeup, skin cream, and fragrances also commonly cause rashes. It’s not well understood how chemical compounds in personal care products trigger these rashes, called allergic contact dermatitis.” Several chemicals, in particular, are known to cause skin irritation.

  • Sulfates
  • Petroleum
  • Alpha-hydroxy acid
  • Glycolic acid
  • Lactic acid

Companies that create products have a legal obligation to ensure that they are reasonably safe. Generally speaking, product liability claims are based on negligence or strict liability. There are three types of product defects that may create liability for manufacturers or suppliers.

  • Design Defects: These defects are inherent to a product, and they exist before a product is manufactured.
  • Manufacturing Defects: These defects occur due to faults in the construction or production of a product.
  • Marketing Defects: These defects occur when a company fails to provide proper instructions or fails to warn about the dangers of a product.

There are a number of reasons why companies may create unsafe products. In far too many situations, companies cut corners in terms of safety in order to save money. In other situations, companies fail to properly test their products before they go to market. Any person injured by a defective product may be able to seek some measure of justice through a civil claim. A product liability attorney can examine all of the unique facts of your case and let you know what your legal options are.
