Inclusive Orbit Playground Merry-Go-Rounds By BCI Burke Recalled Due To Crush Hazard
CHICAGO, ILLINOIS (January 13, 2024) – BCI Burke has issued a recall for its Inclusive Orbit playground merry-go-rounds because they can pose a crushing hazard to children.
The recall was issued on December 26, 2024. Around 415 units were sold, including 6 that were sold in Canada.
According to the recall notice by the Consumer Product Safety Commission, there is a space between the rotating platform and the stationary outer rim.
This space can narrow when the Inclusive Orbit playground merry-go-rounds are in use and create a crushing hazard.
BCI Burke has received two reports of children suffering finger crushing injuries. The products were initially manufactured in the United Kingdom.
Liability for Merry-Go-Round Injuries
Millions of children are injured in playgrounds every year. According to Acta Pediatrics, “Swings, slides, climbing frames, metal bars and merry–go–round accidents accounted for 71% of the 338 playground equipment–related accidents, whereas 36 accidents (10%) occurred without the use of playground equipment.” There could be a number of different causes of playground accidents.
- Accidents may be the result of inadequate adult supervision.
- Playground equipment may be poorly maintained or have design flaws.
- Many injuries are due to poorly designed playgrounds. This may include a playground with hard surfaces in areas where children are likely to fall.
Companies that make playground equipment have a legal obligation to make sure that all of their products are safe. This entails that they perform rigorous tests for all of the real-world scenarios likely to occur. Manufacturers must take into consideration all of the ways that a piece of equipment could be used and even misused. If a piece of equipment has design flaws likely to result in injury, this could form the basis of a product liability claim. There could also be numerous other sources of liability for any playground accident.
- The property owner of a playground could be liable if the playground was in an unsafe condition.
- An institution like a school could also be liable for an accident if school officials were not adequately supervising children.
- The company responsible for maintaining playground equipment could be liable if it fell into disrepair.
Playground accidents are often highly preventable. This is particularly true when an accident is due to faulty equipment. In many circumstances, the companies that manufacture this equipment don’t take into consideration how it could be used by children. It is important for parents to understand that they do have rights if their child is injured by playground equipment. They may be able to seek some measure of justice through a personal injury claim.
