Question:
Is a franchise responsible for problems with their food? I ate at a restaurant this evening and chipped my tooth on a bone that was in the hamburger I was eating. I told the manager who replied…well you should have told brought it to me. I swallowed part of it and then a piece of it was stuck in my tooth. I did manage to remove the bone and kept it. I am going to see a dentist tomorrow.

A distributor/ manufacturer of a product is generally liable for the harm caused by its product if it is unsafe. If the product had a bone it in, you would have a reasonable case against the restaurant. The problem you have here is that the evidence needed to be preserved and the problem reported immediately. Hence, Defendant will defend the case by arguing that the accident never happened.
