Liability for Chicago Pedestrian Accidents

Pedestrians lack the protection of enclosed vehicles and are more likely to be seriously injured in the event of a crash. According to the Chicago Department of Transportation, “68% of Chicago traffic deaths involved drivers traveling at high speeds. Nearly half of pedestrians killed in the city are hit by an SUV or larger vehicle.” City officials should consider a number of measures in order to prevent pedestrian accidents.

  • Cities should work to build safer crosswalks. They should be well-marked, with reflective paint and unique colors.
  • Cities should ensure that sidewalks are well-maintained and accessible to all.
  • Cities should implement traffic signals that prioritize pedestrian movement and allow for sufficient crossing times.
  • Cities should install pedestrian bridges in certain locations.

All drivers have a legal obligation to take measures in order to prevent collisions with pedestrians and other vehicles. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. They must also use their horns when necessary and exercise the proper precautions to avoid colliding with any child or obviously confused person. When a driver fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian collisions tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Depending on the facts of any case, there could be numerous sources of liability for any instance when a pedestrian is injured. A city could face liability if a pedestrian accident was caused by a dangerous condition on public property. For example, a street sign or traffic signal may be covered by foliage, which blocked it from a driver’s view. Any person injured in a pedestrian collision may have legal recourse through a civil claim.
