Liability For Cook County Semi-Truck Accidents
Semi-trucks are involved in thousands of fatal collisions every year. According to the IIHS, “A total of 4,764 people died in large truck crashes in 2022. Seventeen percent of these deaths were truck occupants, 66% were occupants of cars and other passenger vehicles, and 16% were pedestrians, bicyclists or motorcyclists.” There are several reasons that semi-trucks can be particularly dangerous.
- A fully loaded semi-truck traveling 65 mph can take the length of two football fields to come to a stop.
- Semi-trucks can weigh 20 times more than a passenger vehicle, thereby making even a low-impact collision potentially catastrophic.
- Semi-trucks have large blind spots that may obscure the presence of pedestrians and smaller vehicles.
Truck drivers have a legal obligation to take reasonable steps in order to avoid collisions. Many truck accidents are due to truck drivers that make dangerous left turns. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-902), any person intending to turn left must first yield the right of way to any vehicle traveling from the opposite direction that is close enough so as to pose a hazard. It is important that certain steps are taken after any truck accident.
- Surveillance footage should be sought.
- Medical records should be preserved.
- The event data recorder of the truck involved should be reviewed.
Semi-truck accidents are often highly preventable. They tend to involve truck drivers that are committing traffic infractions. Fatigue is another major factor. These drivers are put under an enormous amount of pressure to complete their deliveries as fast as possible. This can lead to dangerous situations. The family of any person who died in a semi-truck accident may be able to seek some measure of justice through a civil claim.
