Liability For Injuries Due To Airplane Turbulence
Injuries due to airline turbulence are very common. According to Euro News, “Between 2009 and 2021, 146 passengers and crew were seriously hurt in incidents of turbulence, according to the Federal Aviation Administration. In December 2022, 20 people were hospitalised after turbulence on a Hawaiian Airlines flight from Phoenix to Honolulu.” There are a number of common causes of airline turbulence.
- Jet Streams: High-altitude, fast-flowing air currents can cause turbulence when aircraft fly through them.
- Weather Fronts: The boundary between different air masses can cause turbulence as aircraft pass through different pressure zones.
- Thunderstorms: Another major cause of turbulence are thunderstorms.
Aircraft are considered common carriers, and their pilots are held to a high standard in terms of safety. Depending on the facts of any case, an airline could be liable for instances where passengers are injured by turbulence. For example, airline crew may have failed to warn passengers when they had knowledge of potential turbulence. There may also be negligence in terms of the flight path decisions. Victims of airplane turbulence tend to suffer very serious injuries.
- Spinal cord injuries
- Head injuries
- Lacerations
- Broken bones
It can be difficult to know where to begin after being injured on an airplane. Victims may need to take extensive periods of time away from work. To make matters worse, airlines will do everything in their power to deny responsibility if someone on their flight is injured. This is why it is so important for accident victims to seek legal guidance as early as possible. An aviation accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
