Liability For Morris Workplace Accidents

Far too many people are killed or seriously injured every year in the United States. According to the Bureau of Labor Statistics, “A worker died every 96 minutes from a work-related injury in 2022 compared to 101 minutes in 2021.  Fatalities due to violence and other injuries by persons or animals increased 11.6 percent to 849 in 2022, compared to 761 in 2021.” There are four types of accidents, in particular, that account for the majority of workplace deaths.

  • Falls
  • Struck-by accidents
  • Electrocutions
  • Caught-In/Between accidents

When a worker is injured on the job, they will typically have recourse through worker’s compensation. Worker’s compensation is a no-fault insurance plan that can help a worker or their family after a serious accident. There is no need for an injured worker or their family to demonstrate that any party was at fault. It is important that evidence is properly preserved after any workplace accident.

  • Eyewitnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough investigation should be conducted.

When a worker is harmed on the job, surviving family members may also have recourse through a third-party liability claim. A third party claim may be possible when an entity separate from a worker’s employer contributes to an accident. A third party may include a general contractor who failed to maintain a job site in a reasonably safe condition.
