Liability For DuPage County Dump Truck Accidents

The truck industry remains one of the most dangerous occupations in the United States. According to the IIHS, “A total of 4,764 people died in large truck crashes in 2022. Seventeen percent of these deaths were truck occupants, 66% were occupants of cars and other passenger vehicles, and 16% were pedestrians, bicyclists or motorcyclists.” Truck companies should take a number of measures in order to prevent collisions.

  • Trucks should be regularly inspected and well maintained.
  • Trucks should be equipped with safety features such as forward collision avoidance systems.
  • Truck drivers should receive ample training on how to operate their vehicles.

Depending on the facts of any case, there could be numerous sources of liability for any dump truck collisions. For example, the company that manufactured a truck or its component parts could be liable for a collision. Companies have a legal obligation to create products that are reasonably safe. If there is a design defect that contributed to a truck accident, this could form the basis of a strict liability claim. It is important that certain steps are taken after any truck accident.

  • Eyewitnesses should be interviewed.
  • Medical records should be preserved.
  • Photos of the accident site should be taken.
  • A thorough investigation should be conducted.
  • The truck involved in the crash should be examined.

Truck accidents can be extremely traumatic for all involved. Victims often suffer life-altering injuries that impair their ability to be gainfully employed. To make matters worse, victims will often be blamed for single vehicle collisions, even if there are extenuating circumstances that contributed to the crash. Any person injured in a truck accident may be able to seek some measure of justice through a civil claim.
