Liability For Champaign County Dump Truck Accidents
Dump trucks can weigh tens of thousands of pounds and can be especially dangerous on the road. According to the Engineering News Record, “Dump truck accidents severe enough that the vehicle had to be towed away rose 9%, hitting 8,206 in 2016, the latest year statistics are available.” Poor driving habits and driving fatigue are two of the leading causes of dump truck accidents. There are a number of steps that dump truck drivers should take in order to avoid accidents.
- Dump truck drivers should check their blind spots before making turns.
- Dump truck drivers should be well-rested before heading out onto the road.
- Dump truck drivers may need to use a spotter when backing into certain locations.
Dump truck drivers will need to get a commercial license and are held to a high standard in terms of safety. Many accidents are caused by drivers that make unsafe lane changes. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-709, “A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety.” When a dump truck driver makes an unsafe lane change, this could form the basis of a negligence claim.
Depending on the facts of any case, liability for a dump truck accident could extend beyond the at-fault driver. If a dump truck driver was working at the time of a collision, their employer could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a dump truck driver may have been helping with a construction project. Victims of dump truck accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Many accident victims may not realize the full extent of their injuries for several weeks or months after any accident. It is common for victims to be left with high medical bills. They may also need to take time off work. Any person that is injured due to the negligent actions of a dump truck driver may have legal recourse through a bodily injury claim. A truck accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
