I was assaulted on the job by the contractor. What are my options?I am a tile setter, and I was assaulted by a general contractor and his son on a job site. As a result of the assault I have 2 chipped teeth and have been unable to work due to back pain. What are my options?

Attorney, Cliff Horwitz:

Chirs,

I can tell you the law in Illinois, which is probably similar to where you are.

You can file a lawsuit against them individually (and perhaps the company).  If it was in the course of employment and they were the aggressor (started the fight) then you can also pursue a WC claim.

If it's a temporary injury, you might file in small claims.  If there is a chronic injury, you should retain a lawyer.
