Does Workers' Comp pay benefits for depression?

Q: Are their any cases of worker's comp paying benefits for depression/anxiety attacks, any mental health problems due to on the job harrassment, etc. in the state of virginia?
--Diana, Roanoke, VA

Attorney Cliff Horwitz:

I cannot speak for the State of Virginia. I can tell you that in almost every state in the nation that depression and anxiety alone is usually NOT compensable in WC cases. The one state I can think of where it is compensable is California. It is unfortunate indeed. However, the government feels that people could make too many false claims since depression can be difficult to objectively diagnose and is a complicated issue causally.

The one who suffer are persons like yourself. Generally for all other states, in order to be compensated for depression/anxiety, there must be an accompanying personal (physical) injury.
