I was injured during a flight

Q; Last week while inflight a pasenger opened an overhead bin and a briefcase fell on my head. My chiropractor said I have mild to moderate whiplash. Can I get America West to pay for my medical? Also is there a chance for additional dollars?

--Lisa, Dallas

Attorney Cliff Horwitz:

America West would not have to pay your medical bills unless they did something careless. If a passenger was the only careless one, then you could not obtain a recovery.

However, if America West has a medical payments coverage policy, then they would pay medical bills to some limit, regardless of who is at fault
