My son was injured during an after-school activity

Q: My son was in the hospital for 7 days because he got hurt during an after- school activity. He almost lost his spleen. There is always supposed to be supervision, and there was none to be found. Can I sue the school for neglect. Can I hold them accountable for medical and pain and suffering? What are my son's rights?
--Tracie, Frazier Park, CA

Attorney Cliff Horwitz:

In Illinois, your son would have the rights to compensation against a school only under limited situations. There are strong tort immunities, which immunize schools from lawsuits. Hence, the law here is poor on that subject. However, each state has unique laws. The law is different in CA and only a California trial lawyer can sort that out for you.
